Is it saying that you have to get that persons phone and install the program for you to be able to spy on them, or can you just find out their number and go from there to spy on them?

If you have the right stuff you don't have to touch the phone, its being done in Iraq all the time. The first cell phones were really insecure(off the shelf components could let you hear everything), the new ones are more secure and usually the person has to physically clone your sim card. The really scary part is with the newer standards of 911 and tower triangulation, all networks are required to give locations, even if your phone doesn't support GPS they can still be located, there is programs out there that are specifically for law enforcement the allow them to do just about anything on your phone.
